Job Description

An employee in this class provides assistance to attorneys in researching questions of law, investigating facts and preparing various legal documents. Duties are performed under the supervision of an attorney.

KEY RESPONSIBILITIES::

  • Research legal issues and questions of law for reference and use in court by attorneys.

  • Research case law and prepares memoranda.

  • Reviews case files to ensure legal sufficiency, a sound factual basis for evidence, and the availability of evidence in pending civil or criminal matters.

  • Prepares subpoenas for attorney review.

  • Prepares draft of discovery and other legal responses for attorneys to review.

  • Drafts routine motion papers in civil and/or criminal matters, and, after review by an attorney, files papers with the court.

  • Speaks with caseworkers from Department of Social Services and obtains paperwork related to the investigation.

  • Enters notes into the department’s Court Alert case management system as to what transpired on court cases.

  • May be asked to appear in court with an attorney.

  • Creates a court calendar for use by all members of the bureau

MINIMUM QUALIFICATIONSOPEN COMPETITIVEEither:(a) Graduation from a college with federally-authorized accreditation or registration by NY State with a Bachelor's Degree in Paralegal Studies;OR(b) Graduation from a college with federally-authorized accreditation or registration by NY State with a Bachelor's Degree, and successful completion of a Paralegal Assistant certificate program given by a college or business school with federally-authorized accreditation or registration by NY State;

OR

(c) Graduation from a college with federally-authorized accreditation or registration by NY State with an Associate's Degree in Paralegal Studies and two (2) years of clerical experience in a law office, at least one (1) year of which included drafting motions and doing preliminary legal research; or,OR(d) Successful completion of a Paralegal Assistant certificate program given by a college or business school with federally-authorized accreditation or registration by NY State and three (3) years of clerical experience in a law office, at least two (2) years of which included drafting motions and doing preliminary legal research.

This Role Is A Provisional Appointment

A provisional appointment, which occurs only in the competitive class, is a temporary appointment to a position for which no eligible list exists or for which an eligible list exists with fewer than three candidates who are willing to accept the position. In order to become permanent, the employee who is provisionally appointed must take the next examination for the position in question. The appointment to the position is then made from among the three highest scoring passing candidates who indicate their willingness to accept the position. Civil Service law does not compel the appointing authority to choose the provisional employee should he or she be one of the three candidates
