Job Description

Job Summary

The Deputy Prosecutor III provides professional legal services, which include prosecuting felony, misdemeanor, and/or juvenile cases, making charging decisions, negotiating case settlements, and assisting the County Prosecutor with other legal and administrative work necessary to achieve the objectives of the office. Assignments may be made to prosecute specific types of cases such as major crimes, complex litigation, serious felony, and civil cases. The position provides general direction to assigned legal and other assistant support positions but is not a supervisory position. While the work is performed under the general supervision and authority of the County Prosecutor, there the position is expected to exercise independent judgment, initiative, and discretion to manage the assigned caseload.

Essential Duties and Responsibilities

The Deputy Prosecutor III assumes daily responsibility and performs tasks in the following areas:

  1. Investigates, prepares, and manages felony, misdemeanor, and/or juvenile cases for trial, including but not limited to: reviewing charges and evidence, conducting legal research, interviewing affected parties, preparing required legal and court documents, preparing, and arguing briefs, and attending court proceedings,
  2. May be assigned specific types of cases such as major crimes, complex litigation, serious felony, and civil cases, or other complex specializations,
  3. Makes charging decisions following review and evaluation of police reports and other evidence and in consideration of applicable law,
  4. Negotiates case settlements with opposing counsel,
  5. Advises and consults with police officers, detectives, attorneys, defendants, victims, witnesses, and other interested and affected parties,
  6. Represents the County's interest in court,
  7. Answers communications from the public relative to legal matters affecting the County,

Other Duties and Responsibilities:

  1. May be assigned on call after regular hours to respond to emergency situations, or other duties as assigned or necessary to aid the department in the completion of its objectives.
  2. Performs all work duties and activities in accordance with County policies, procedures, and safety practices.

Competency Requirements

The Deputy Prosecutor III obtains, possesses, and deploys the following knowledge, skills, and abilities to effectively perform their responsibilities:

Knowledge Of:

  1. Legal, court, and judicial procedures, rules, terminology, methods, documents, practices, and objectives typically used in a courtroom environment,
  2. Applicable federal, state, and municipal laws, statutes, ordinances, and code needed for practice of the assigned caseload and duties, and their application to county government,
  3. Legal research methods and applications used to determine established precedents and sources of legal references applicable to the County caseload and current legal issues, and

Skill To:

  1. Analyze evidence, organize facts, identify precedents, weigh alternatives, and anticipate possible to develop and deploy an appropriate legal strategy and logical argument(s),
  2. Appear without assistance in court and other judicial proceedings and be able to present evidence, arguments, testimony, and witnesses before a judge or jury,
  3. Negotiate complex legal issues with opponents, and bring interested and affected parties to consensus,
  4. Operate standard office equipment, including a personal computer, printer/scanner, and job-related software applications, and
  5. Make significant/substantial legal decisions in individual cases based on a combination of factors including the law, policy, and rules of ethics.

Ability To:

  1. Communicate effectively, both orally and in writing, for purposes of advocating, persuading, negotiating, and counseling for or on behalf of the County,
  2. Maintain a professional demeanor during all situations, and maintain effective working relationships with other County employees, staff, attorneys, law enforcement personnel, victims, witnesses, supervisory personnel, agency stakeholders, state and local elected and appointed officials, and the public, and
  3. Perform a wide variety of duties and responsibilities with accuracy and speed under the pressure to meet time-sensitive deadlines, and be able to perform multiple tasks simultaneously, manage case priorities, including handling interruption and change, and
  4. Demonstrate character, integrity, and ingenuity in representing the County.

Minimum Education, Experience and Training

  • Graduation from a school of law accredited by the American Bar Association with a Juris Doctorate Degree (JD),
  • Admission to the Idaho State Bar with an active license to practice law in the State of Idaho,
  • Meet any annual licensing requirements and maintain a membership in good standing in the Idaho State Bar Association, and
  • Three (3) years of career experience and three (3) years of Bannock County prosecuting experience, or equivalent combination of experience.

Essential Physical Abilities and Working Environment

  • Sufficient clarity of speech and hearing or other communication capabilities, with or without reasonable accommodation, which permits the employee to discern verbal interaction and to communicate effectively in person, in writing, on a telephone, and in a courtroom environment,
  • Sufficient visual acuity, with or without reasonable accommodation, which permits the employee to comprehend written filings and supporting documents, and to assist in the preparation, monitoring, and litigation of all cases,
  • Sufficient manual dexterity, personal mobility, flexibility, and balance, with or without reasonable accommodation, which permits the employee to work in an office environment, lift up to 20 pounds, and attend scheduled court appearances.
  • The principal duties of this position are performed in a general office and courtroom environment.
